These Terms of Use ("Terms") govern your access to and use of the Creative Entrepreneurs Club website, membership platform, online courses, community spaces, events, and any related services (collectively, the "Services"). By registering for membership, purchasing a course, or accessing any part of our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Services.
These Terms constitute a legally binding agreement between you ("Member", "you", "your") and Creative Entrepreneurs Club ("CEC", "we", "us", "our"). They are governed by the laws of Scotland, and any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
1. ABOUT US
1.1 Creative Entrepreneurs Club ("CEC") is a people-powered membership network that connects, upskills, and empowers creative freelancers and businesses. We operate primarily through our website at creativeentrepreneursclub.co.uk and through our hosted learning and community platform, currently provided by Thinkific Labs Inc. ("Thinkific").

1.3 References in these Terms to "Thinkific" refer to the third-party platform through which we host our online courses, masterclasses, and member community spaces. Your use of the Thinkific-hosted platform is subject both to these Terms and to Thinkific's own Terms of Service and Community Terms of Use, available at thinkific.com/terms-of-service and thinkific.com/communitytou. In the event of any conflict between our Terms and Thinkific's terms as they apply to your use of our Services, these Terms shall take precedence to the extent permitted by law.
2. ELIGIBILITY AND ACCOUNT REGISTRATION
2.1 You must be at least 18 years of age to register for a CEC account or access any paid Services. By registering, you confirm that you meet this requirement.
2.2 You must provide accurate, complete, and truthful information when creating your account. You agree to keep your account details up to date. We reserve the right to suspend or terminate any account where profile information is found to be inaccurate, false, or misleading.
2.3 You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your username or password with any other person. If you become aware of any unauthorised use of your account or any breach of security, you must notify us immediately at [email protected].
2.4 Each account is personal to the individual registered member. Corporate or team memberships (where available) are subject to separate terms agreed at the point of purchase. Accounts may not be transferred or sold to another person.
3. MEMBERSHIP TIERS AND SERVICES
3.1 CEC offers the following membership options (subject to change at our discretion, with reasonable notice):
Free Membership — access to the Opportunities Board, public content, and our regular Monday Morning Meetups and selected events.
Premium Membership — full access to all member benefits including CEC Social (our private networking platform), masterclass sessions, specialised community groups, curated job listings, 1-2-1 advisory sessions, and access to all content hosted on our Thinkific platform.
Corporate Membership — premium-equivalent access for organisations, subject to a separate agreement.
3.2 The specific features, content, and benefits included in each membership tier are as described on our website at the time of purchase. We reserve the right to modify, add, or remove features from any tier, giving Members reasonable advance notice of material changes.
3.3 Courses and training programmes may be offered on a standalone paid basis in addition to, or separately from, membership. The terms in this document apply to all such purchases unless specific additional terms are presented at the point of sale.
4. FEES, PAYMENT, AND CANCELLATION
4.1 Fees for paid memberships and courses are as set out on our website at the time of purchase. All prices are stated in pounds sterling (GBP) and, where applicable, inclusive of VAT at the prevailing rate.
4.2 Payment for monthly or annual memberships is processed on a recurring basis via the payment method you provide. By providing payment details, you authorise us to charge the applicable fees at the start of each billing period.
4.3 Cancellation of a recurring membership: You may cancel at any time via your account settings on our Thinkific-hosted platform. Cancellation will take effect at the end of your current paid billing period. You will retain access to paid Member benefits until the end of that period. No partial refunds are issued for unused time within a billing period, except where required by law.
4.4 Standalone courses and programmes: Once a course has been accessed, no refund is ordinarily available. If you experience a technical failure that prevents access before you have engaged with any course content, please contact us at [email protected] within 14 days of purchase. We will review requests on a case-by-case basis.
4.5 Statutory cooling-off rights: If you are a consumer (an individual acting outside your trade, business, or profession), you have a statutory right to cancel a digital content or service contract within 14 days of purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. However, if you expressly request and begin to access the digital service or content during this period, you acknowledge that your right to cancel may be lost once access has commenced. We will always confirm this to you at the point of purchase.
4.6 We reserve the right to adjust our fees. We will give you at least 30 days' written notice of any price changes. Continued use of the Service after a price change takes effect constitutes your acceptance of the new fees.
5. ACCEPTABLE USE OF OUR SERVICES
5.1 You agree to use our Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Services.
5.2 You must not:
Use the Services for any unlawful purpose or in any way that violates applicable Scots law or the laws of the jurisdiction in which you are based.
Reproduce, duplicate, copy, sell, resell, or exploit any part of our Services or content without our express written permission.
Interfere with or disrupt the integrity or performance of our platform or third-party systems.
Use automated tools (bots, scrapers, crawlers) to extract data from our Services.
Attempt to gain unauthorised access to any part of our Services, accounts, or systems.
Engage in any conduct that we reasonably consider to be inappropriate, harmful, or detrimental to CEC, its Members, its staff, or its reputation.
6. COMMUNITY GUIDELINES
6.1 Our community spaces — including CEC Social, our Thinkific-hosted course discussions, group forums, live meetups, and masterclasses — are designed to be safe, inclusive, and professionally supportive environments. All Members are expected to uphold these values at all times.
6.2 Be Respectful and Inclusive
Treat all Members, instructors, moderators, and CEC staff with courtesy and respect, whether online or in person.
Do not post, share, or direct content that is discriminatory, hateful, offensive, or which could be construed as harassment, bullying, or threatening behaviour of any kind.
Respect diversity. Content that promotes or incites hatred on the basis of race, ethnicity, religion, gender, sexual orientation, disability, nationality, or any other protected characteristic will result in immediate removal and may result in account termination.
Verbal or written abuse of any kind — including threats, intimidation, or retribution — directed at any Member, instructor, moderator, or CEC representative will result in immediate suspension or termination of your account.
6.3 Keep Content Appropriate and Original
Post only original content, or content you have the right to share. Do not plagiarise or infringe the intellectual property rights of others.
Ensure all information you share is accurate to the best of your knowledge. Do not spread misinformation or make false claims.
Do not post explicit, obscene, pornographic, or otherwise inappropriate material.
Do not upload or share files that contain viruses, malware, corrupted files, or any material designed to exploit vulnerabilities in systems or other users' devices.
Do not share the personal information of other individuals (such as contact details, financial information, or other private data) without their explicit consent.
6.4 No Spam or Unsolicited Promotion
Do not post repetitive, irrelevant, or unsolicited promotional content ("spam") in community spaces, forums, direct messages, or meetups.
Promotional posts about your own work or business should be shared only in designated spaces created for that purpose (e.g. an Opportunities Board or a self-promotion channel where applicable).
Do not run automated messaging, spam campaigns, or mass unsolicited direct messages to other Members.
6.5 Comply with Legal Standards
Do not post content that promotes, encourages, or facilitates illegal activities.
Do not infringe copyright, trademarks, or other intellectual property rights of any third party.
Ensure that your content complies with all applicable law including, but not limited to, the Equality Act 2010, the Online Safety Act 2023, and data protection legislation.
6.6 Moderation and Enforcement
6.6.1 We and our appointed moderators reserve the right, at our sole discretion and with or without prior notice, to remove, edit, or restrict any content that we consider to be in breach of these Community Guidelines or these Terms.
6.6.2 Members who violate these Guidelines may have their content removed, their account suspended, or their membership terminated without refund, depending on the severity of the breach.
6.6.3 You must not attempt to evade account suspensions or bans, or to circumvent the directions of community moderators or administrators.
6.6.4 If you encounter content that you believe violates these Guidelines, please report it using the reporting tools available within the platform, or by contacting us directly at [email protected].
7. INTELLECTUAL PROPERTY
7.1 All content created and published by CEC — including but not limited to course materials, videos, articles, guides, toolkits, branding, and website content — is owned by or licensed to CEC and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, adapt, or commercially exploit any CEC content without our prior written consent.
7.2 You retain ownership of all original content you post, submit, or share within our Services ("User Content"). By posting User Content, you grant CEC a non-exclusive, royalty-free, worldwide licence to use, store, display, and moderate that content solely for the purpose of operating and improving our Services. This licence ends when you delete your content or close your account, except where your content has been shared with others and cannot reasonably be retrieved.
7.3 You represent and warrant that any User Content you post: (a) is your original work or you have the right to share it; (b) does not infringe the intellectual property rights of any third party; and (c) complies with these Terms.
7.4 Course content purchased through our Thinkific-hosted platform is licensed to you personally for individual study only. You may not share, resell, screen-record, or redistribute course content without our express written permission.
8. THIRD-PARTY PLATFORMS AND LINKS
8.1 Our courses, masterclasses, and member community spaces are hosted on Thinkific's platform. Thinkific is an independent third-party provider and operates its own terms of service and privacy policy. We are not responsible for any interruption, data loss, or service failure attributable to Thinkific's systems.
8.2 Our Services may contain links to third-party websites, tools, or resources. These links are provided for convenience only. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party sites.
8.3 Live sessions, meetups, and events may be hosted using third-party video conferencing tools (such as Zoom). Your use of those tools is subject to the terms and privacy policies of the relevant provider.
9. DATA PROTECTION AND PRIVACY
9.1 CEC is committed to protecting your personal data and complying with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) as retained in UK law by the European Union (Withdrawal) Act 2018, and the Data Protection Act 2018.
9.2 We act as the data controller in respect of the personal data you provide to us when registering, purchasing, or participating in our Services. Where we use Thinkific to process data on our behalf, Thinkific acts as a data processor subject to a data processing agreement.
9.3 We collect and process your personal data (including name, email address, payment information, and usage data) for the following purposes:
To create and administer your account and membership.
To process payments and issue receipts.
To provide access to courses, community spaces, events, and other Services.
To send you service-related communications, including updates about your membership.
To send you marketing communications, where you have consented to receive them.
To improve and develop our Services and to comply with our legal obligations.
9.4 Your data rights: Under UK GDPR, you have rights including the right to access your personal data, to rectify inaccuracies, to request erasure, to restrict or object to processing, and to data portability. To exercise any of these rights, please contact us at [email protected].
9.5 You have the right to lodge a complaint with the Information Commissioner's Office (ICO) if you believe your data has been processed unlawfully. The ICO can be contacted at ico.org.uk or on 0303 123 1113.
9.6 Full details of how we collect, use, store, and share your personal data are set out in our Privacy Policy, available at creativeentrepreneursclub.co.uk/privacy-policy. The Privacy Policy forms part of our overall agreement with you and should be read alongside these Terms.
10. COOKIES
10.1 We use cookies and similar technologies on our website to enhance your browsing experience, analyse site traffic, and support the functionality of our Services. By using our website and clicking "Accept All" on our cookie banner, you consent to our use of cookies as described in our Cookie Policy. You can manage your cookie preferences at any time via the "Cookie Settings" option on our website. Necessary cookies (essential for site function) are always active.
11. DISCLAIMERS AND NATURE OF SERVICES
11.1 Our Services are provided for educational, informational, networking, and professional development purposes. Content shared by CEC, its instructors, and its Members is provided in good faith but does not constitute professional legal, financial, tax, or business advice. You should seek independent professional advice before making any business or financial decisions.
11.2 We make reasonable efforts to ensure that course content and community resources are accurate and up to date, but we do not guarantee the completeness, accuracy, or fitness for purpose of any content. The Services are provided on an "as is" and "as available" basis.
11.3 We do not guarantee uninterrupted or error-free access to our Services. Availability may be affected by factors outside our control, including third-party platform outages (including Thinkific), internet connectivity issues, or scheduled maintenance.
12. LIMITATION OF LIABILITY
12.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Scots law.
12.2 Subject to clause 12.1, we shall not be liable to you for any indirect, consequential, special, or incidental loss or damage, including loss of profits, loss of business, loss of data, or loss of opportunity, whether arising in contract, delict, or otherwise, even if we have been advised of the possibility of such losses.
12.3 Subject to clause 12.1, our total aggregate liability to you arising out of or in connection with these Terms or your use of our Services shall not exceed the total fees paid by you to CEC in the 12 months preceding the event giving rise to the claim, or £100, whichever is greater.
12.4 If you are a consumer, these Terms do not affect your statutory rights under Scots and UK consumer protection law, including your rights under the Consumer Rights Act 2015.
13. SUSPENSION AND TERMINATION
13.1 We reserve the right to suspend or terminate your access to any or all of our Services at any time, with or without notice, if we reasonably believe you have breached these Terms, acted in a manner harmful to CEC or its Members, or if required to do so by law.
13.2 On termination of your membership, your access to paid content and community spaces will cease. We are not obliged to retain your User Content following termination, though we will handle any personal data in accordance with our Privacy Policy.
13.3 You may terminate your account at any time by contacting us at [email protected] or by following the cancellation process in your account settings. Termination does not entitle you to a refund of any fees already paid, except as set out in clause 4.
13.4 Clauses relating to intellectual property, limitation of liability, data protection, and governing law shall survive termination of these Terms.
14. CHANGES TO THESE TERMS
14.1 We may update these Terms from time to time to reflect changes in our Services, applicable law, or our operating practices. We will notify you of material changes by email or by posting a prominent notice on our website, with at least 14 days' notice before the changes take effect.
14.2 Your continued use of our Services after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our Services and cancel your membership.
15. GENERAL
15.1 Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and CEC in relation to your use of our Services and supersede all prior agreements, representations, and understandings.
15.2 Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
15.3 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.4 Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor organisation in the event of a merger, acquisition, or sale of assets.

16. GOVERNING LAW AND JURISDICTION
16.1 These Terms are governed by and construed in accordance with the laws of Scotland.
16.2 Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the Scottish courts.
16.3 If you are a consumer resident elsewhere in the UK, you may also have the right to bring proceedings in the courts of your home jurisdiction under applicable consumer protection law.
